New Jersey - Bill A3275

I'm a bit surprised that someone more familiar with the issues hasn't already posted. This bill, and it's negative impact on sportfishing (not to mention hunting) is being discussed extensively at njtrout...

As I understand it, Bill A3275, will change the make-up and mission of the New Jersey Fish and Game Council.

Critical are:
  • This bill would provide that the code is for the purpose of providing a properly managed and balanced system, and would delete the consideration for use and development of fish and game for public recreation and food supply.
  • It would eliminate the requirement that six out of 11 members of the council, are required by law to be sportsmen. Members would be appointed by the Governer without regard for geographic representation of the regions of the State.
Of interest to hunters (re the "bear hunt" controversy):
  • This bill expand the duties of the council to include: investigating the use of non-lethal alternatives for dealing with wildlife conflicts.

As much as I dislike bringing politics into our sport, I think it's time for New Jersey sportsmen to write a few letters to our representatives, opposing the bill, even if you're not happy with the status quo. It's also a bad time to express any dissatisfaction you may have with the current set-up.

Depending on who the governor is when appointments are made, this could have the effect of handing the council over to Animal Rights Activists, including those who oppose fishing for sport and/or food.

Pete, thanks for bringing this to our attention, I hadn't heard about it previously. This bill could become a serious problem if it gets passed. It seems like an excuse for cutting the budget for stocking programs and the like. Change the code, and then cut the budget and say the money isn't neccessary because of the revised code. Everybody needs to get on the horn to their representative and give them hell about it. A quick five minute phone call can make a world of difference.

It could be a lot more insidious than that. In theory, the DFW is supported by license and stamp sales. If sales decline, then programs (like stocking) could be cut back. If they go up, the DFW activities can be scaled back up.

However, by changing the mission and composition of the council, they can "stack the deck" and pave the way towards eliminating hunting and fishing activities altogether.

Here's another one that is of great concern to all sportmen in NJ. This one is a back-door ban on bird hunting and dog ownership!

This is a ridiculous and ambiguous bills - all 56 pages of it. The language is very difficult to follow and presumes guilt until you are proven innocent of any charge of animal cruelty.

Remember that real hard copy letters are far more influential than e-mail!

The bill is undergoing more amendments. It's best to simply object with
the points on the AKC alert and the NAIA letter. See links to the alert and letter below.

Here are some areas that the bill is very unclear on to give you an understanding of the many ridiculous items in this bill:

1. Dogs crated in vehicles at shows. This could be interpreted as cruel and inhumane by uninformed "Do-Gooders".

2. Allows no tethering less than 15', no matter how long it's for. This would apply to field trials, grooming tables, and even your morning stop at Starbucks with your pooch tied to the pole while you run in for your morning cup of Joe.

3. Provides immunity from any civil or criminal liability for any person who submits a report of animal cruelty, regardless of their own responsibility and regardless of whether the accusations are purely vindictive in nature.
4. Allows forfeiture of animals even before full disposition of a case is achieved. This creates a system by which the accused are guilty until proven innocent, and is a violation of due process rights.
5. May force people who cannot financially afford it to treat an illness that might be treatable with heroic measures. (Can their vet who won't sign off on an incurable condition report them to the authorities?)
What you can do:
• Read the NAIA letters written by Patti Strand and Barbara Reichman. These letters explain some of the issues and will help you in composing your own letters.

• Read the AKC Alert included below and use their bulleted talking points in your letters. Go to their site, American Kennel Club - akc.org for additional information
• Write to both the Majority and Minority leaders of the NJ Assembly as well as all of the legislators, especially those from your district.
• Alert all pet owners in the state and educate them that this bill will negatively effect EVERYONE - not just show people or breeders. Enlist them to write letters of opposition.
• If you are from out-of-state, you can still write and tell them how much money you spend in NJ for dog shows, field trials, hunt tests, agility trials, etc. Money talks and New Jersey hosts some of the biggest dog shows in the country from all-breed shows, (Trenton Kennel Club) to National Specialties. Remind them that the pre-Westminster Specialties are now held in Secaucus, NJ.

The American Kennel Club is alarmed by the provisions of New Jersey
Assembly Bill 2649. The proposal attempts to replace New Jersey's
already comprehensive and reasonable animal cruelty laws and humane care
standards with an unnecessary, confusing, and haphazard system that will
not only affect the health of the general public, but will also threaten
the due process rights of individual animal owners.

The AKC believes that dog owners bear a special responsibility to their
canine companions to provide proper care and humane treatment at all
times. We take animal cruelty cases seriously—in fact, anyone convicted
of animal cruelty involving a dog will have all AKC privileges
suspended. The AKC also supports reasonable and enforceable laws that
govern dog ownership, as is currently provided by New Jersey's regime of
common-sense laws and regulations. Among AB 2649's 56 pages, its most
egregious proposals include the following:


* Any person, regardless of their lack of knowledge, training, or
expertise, could accuse another person of animal cruelty, while
receiving immunity from prosecution for cruelty themselves. Without
providing redress for someone who has been unjustifiably and
vindictively accused of animal cruelty, this provision is ripe for abuse.

* The use of a living bird or other animal in events would be
considered animal abuse. This would effectively make illegal many
performance events, including Earthdog, Coonhound, and Sporting dog hunt
tests and field trials.

* The definition of "minimum care" required for the care of animals
will be lessened to include "veterinary care deemed necessary by a
reasonably prudent person". AKC believes that veterinary care in all
cases should be administered with a professional standard of care with
the highest levels of professionalism and competence, as deemed
necessary by a licensed veterinarian.

* The definition of "cruelly restraining a dog" specifically bans
the tethering of dogs with less than 15 feet of tether. This provision
does not expressly provide an exemption for dogs being groomed on
grooming tables in any setting, including grooming salons and dog shows.


With substantive animal cruelty provisions already in place, New Jersey
state and local governments need to enforce existing law in cruel tethering cases. Irresponsible owners who are not providing humane treatment for their animals can and should be prosecuted under current law.
 
Pete...thanks for the info. I wasn't aware of this at all! I contacted Lance, Doherty and Karrow and let them know my concerns. I also read through the string of messages on NJTrout....interesting discussions. The last thing this state needs are more political appointment positions, especially in areas like Fish and Game. :mad:

I see my post linking to the one here regarding the animal cruelty bill that is also pending was deleted from NJTROUT.

I would like to say that my intent was not to distract focus from the bill that directly affects the NJ game council, but to show that there is more going on that we need to be concerned about.

It is an attempt to get a foot in the door to end all fish and wildlife stocking by labeling it as “cruelty”.

Use of live birds for dog training or field trial events considered “cruelty to animals”? Next, stocking of pheasants and quail for sporting purposes will be considered “cruelty” and prohibited. Then the stocking of gamefish will not be far behind.

All the anti’s need is to establish a legal precedent. Don’t be stupid and think the proposed law only applies to dogs and dog shows. Read between the lines. With license sales dropping, and the general apathy rampant in the sporting community, we are in trouble unless we act.

I hope you're right, but I considering the influence the ARAs have been exercising recently, I doubt it.

Why else eliminate "recreation and food" as a consideration?

Why else remove sportsmen seats from the council?

Science?
Political considerations have over-ridden science a lot in NJ recently. I'm not a hunter, but the NJ "Bear Hunt" controversy makes a good barometer of which way the wind is blowing. So far, three administrations in a row have caved in to pressure from the ARAs, and ignored the recommendations of the division's scientists, after the council endorsed them.... (I'm not counting "acting governors" in my three in a row statement).

Yes, we need more fishermen/women on the council, but this is a bad time to express dissatisfaction.

To be honest, I was tempted to split it off to it's own topic. However, it wasn't really flyfishing related.

Upon reflection, I decided to let it stand, as an example of the extremes the ARAs go to while manipulating legislators.

True, it is not flyfishing related. Delete it if you like.

And when hunting & fishing is finally banned in The People's Republic of New Jermany, (and if I'm allowed to leave) I'll just move to another state.
 
Pete- I appreciate your latest post. Sounds much less alarmist and reactionary and much more like cautious concern. I truly think the best thing for this bill is amendment. Maybe the proposed amendments aren't the best, but they're a start. Is there an action group of people with our concerns who canwrite a draft the way we'd like to see it and send it to our state legislators? I truly believe that we need some hard science in put, not political hacks. If everyone would just listen to the conservation biologists who are trained in this stuff we might have a real plan, and actually follow it.

I guess we just see things differently.

I see the elimination of the seats reserved for sportsmen as a way to make it easier to appoint political hacks who will bend to the will of the administration.

I see the elimination of recreation (and food) as a consideration as a prelude to eliminating sportfishing (and hunting). It's not going to happen right away, it'll happen gradually, perhaps not in my lifetime, but some of our younger members may see the end.

BTW: The "scientists" are employees of the division, they make recommendations to the council. Under the current system the council usually supports the scientists recommendations on major issues.

I delayed posting this topic because I was hoping it would be started by someone more adept at explaining the issues.... Have you read the ongoing discussion at NJtrout (link in my first post above), expecially the earlier posts. They may be explaining it more eloquently than I can.

Pay attention to anything Bob Soldwedel says about the politics. As a retired fishries chief, he's in a position to know.

My fellow sportsmen, women, I don't live in NJ but this is very disturbing. What I can't understand is how these bills get started in the first place. You must take a stand to defeat these. If I could be of any help please let me know.
 
FYI....I received replies to two of my messages. I have not heard from Leonard Lance yet, but that doesn't surprise me as it is rare he replies to anything I try to contact him about.

I am pleased to inform you that Assemblywoman Karrow shares your opinion
about A-3275 and is strongly opposed to this bill. Last week, prior to
the bill being heard in the Assembly Environment Committee, she
proactively reached out to sportsmen throughout the State urging them to
attend the hearing and speak out against the bill. For your
information, I have pasted the e-mail she sent out last week below my
signature line.

While, unfortunately, the bill passed out of Committee, you can be
assured that should A-3275 come before the General Assembly for a vote,
she will vote "no."

The Bill, A-3275, changes the membership composition of the Fish & Game

Specifically, the bill reduces the number of members from 11 to 7 and
removes the geographic representation and we suspect is a means for
removing the sportsmen from the Council.

Also this bill was supposed to be heard in the Assembly Agriculture and
Natural Resources Committee where there is a 3-2 ratio of Democrats to
Republicans and for an "unexplainable" reason this bill has been
transferred to the Environment committee where there is a 5-2 ratio of
Democrats to Republicans.

This is going to be the ONLY public hearing before this goes to the
floor for a vote by the entire General Assembly. Please have you and
your members make this a priority and come to Trenton and speak against
this bill.

This is NJ, without a doubt the most crookedest state in the Union. Money talks and the citizens of this state be damned.

If you are serious about helping, I know there are about 42 NJ State Legislators and 1 Governor that we can buy.

I have been contemplating this myself, and proclaiming myself King Skim of New Jersey. Then I too shall be able to "skim" pensions, lottery monies, NJSP speeding ticket kick backs, Trump casino protection funds, and of course, let us not over look the tributes from the Teachers Union.

My first act as King Skim of New Jersey after I open a number of off-shore bank accounts is to appoint YOU as the official NJ Streamer tyer and president of the Municipal Worker's Union. Don't worry, it is a "no show" job. Salary of $1.3m per year and what else you can steal from Pay To Play.

With that being said, your new streamer.. How about naming it... "King Skim?" Has a nice ring (the sound of a register opening) to it and besides your family's future depends upon it.

Second act, sell Ken Lockwood Gorge to developers. Be the first to own a 3,500 ft3 house built over the stream.

Ah, I just love NJ......

The changes this bill proposes will not get a crew of dedicated scientists appointed to the fish and game council. The appointments will go to big campaign donors, friends, or other people the administration might owe a favor. Want an example, take a look at the current presidential administration and see how many of the appointees are actually qualified for their jobs. Its sad, but thats how things go in politics, and it would be naive to think it would work differently in this situation.

Don't let the fact that they appear to be targeting hunting fool you. That just a way of minimizing their opposition, and an attempt to catch us off guard.

IMHO: Since the antisportsman letter writing campaign might lead a legislator to believe that only hunters would object, it might be helpful if your letter mentions that you're a fisherman.

Earlier, in one of Scott's posts it was mentioned that a written (paper) letter would be more effective. That's true but ...
If you're delaying because you don't have time to compose a written communication, just go ahead and sent an e-mail. Do the snail mail letters and make the phone calls when you get time.

Reading one of Screwy Stuie's other pages made me want to throw up. I've never seen so much conjecture and statistic twisting in my life. How ANYONE with an IQ over 70 can take this guy seriously is beyond me.

I think the guy needs an intervention. :devious:
 
I was contacted directly by Marcia Karrow, and am pleased she took the time to respond to my e-mail and ensure I was aware of her position. This expression of concern for the people in her district and her willingness to listen to them is exactly why I have continued to support her in each election.

That said I received the same generic, non-committal response from Mike Doherty. Pretty disappointing - Rest assured that based on his lack of concern regarding his constituents we all need to pay very close attention to his actions so we can make better decisions in the next election.
 
I just emailed my legislators, don't forget to compliment the current Fish and Game Council for professionalism, experience, science based management that is top notch and something to be proud of. To just say I am opposed to the bills is not enough, we need to put the current guys on a pedestal.
